WINTER STORAGE AGREEMENT

The Owner _____________________________ hereby requests the THREE MILE HARBOR BOAT YARD, INC. to haul and store the above vessel for the period beginning October 15, 2002 and ending June 1, 2003.

The cost for said hauling and storage only is $___________ and is payable within 30 days of this Agreement. This price excludes any work such as winterizing, bottom scrub, battery storage, etc…

ON BOATS STORED INSIDE: All work will be done by Yard personnel only.

ON BOATS STORED OUTSIDE: All work on the outside of the hull from the deck down will be done by Yard personnel only, with the exception of cleaning and waxing of the hull which may be done by the Boat Owner and immediate family at a $3.50/per feet surcharge. This charge will be paid at the time of Winter Storage billing with this option. The Boat Owner must purchase all materials from the store at THREE MILE HARBOR BOAT YARD, INC. If the Owner decides at a later date that he will clean and wax the hull himself, there will be a $4.00/per ft. surcharge applied.

ON ALL BOATS STORED INSIDE & OUTSIDE: All materials will be supplied by the THREE MILE HARBOR BOAT YARD, INC.

No Owner can hire or engage any contractor, mechanic, installer, repairman, electronic or material personnel or other paid workmen to perform work on the boat without the prior written consent of the Boat Yard. The Boat Yard reserves the right to refuse any and all work on the hull of all boats and also reserves the absolute right to refuse such consent to any and all such persons and to require the Boat Yard personnel only perform desired work, provided however, that the owner of any boat stored outside may perform work on his or her own boat above hull deck joint besides the cleaning and waxing of the hull as stipulated.

The Boat Yard shall exercise reasonable care in safe-guarding the Owners' property. Nonetheless, the owner shall be solely responsible for the provision and maintenance of any insurance the owner deems necessary for the protection of the stored vessel. The Boat Yard shall not be held responsible for any losses incurred except where such loss is the direct and actual result of the Boat Yard work on the Boat.
